وفي قرص القمر أرى وجهك

و أظل أتقلب يمينا ويسارا
أغفو لحظة فأراك تمشي بداخلي
فكيف أنام وأنت لست بحضني
كيف أنام و القلب أسير مكبل
بسلاسيل ومفتاح القفل لديك

فكل الشراشيف على جسمك

إغتسلت بدموعي و كفني رداؤك

Dr. Tzemin Ition Tsai(蔡澤民博士) 
                            
was born in Taiwan(Republic of China). As a professor at Asia University(Taiwan), the chief editor of “Reading, Writing and Teaching” academic text, and served as an editor or important position in many international literary journals. He also writes a long-term columns for  “Chinese Language Monthly” in Taiwan. Many famous poets of the world through his Chinese translations and introductions were able to be recognized by the people of Taiwan. 
Tsai has won many famous literary awards either in his own country or internationally. His  literary works have been anthologized and published in books, journals, and newspapers in more than 40 countries by more than a dozen languages. His major works in literature include: “Angel Heart”, “My Kick, Kick, Kick”, “The Wind Passes Through the Bamboo Forest”, “The Mirror in Heart Bottom, The Fog Full of Sky!”, etc.

A heavy cotton overcoat
No room for compromise

Hurrying vehicles
Under the acquiescence of aural comprehension
No longer an interference
What can wake him up now
Only left
His grandson's voice

That doesn't require a fine aural comprehension

  1. Where Should The Youth Dreams Go?


Mountains towering and thick
Vast and deep water flowing around the valley
The past just In front of my mind has not disappeared
In the baggage
Loaded the earnest exhortations of my parents
My chest is crammed into a blah poem
A poetry
With where the youth dreams go
Ignorant! Ignorant! Ignorant! Ignorant! Ignorant! Ignorant! Ignorant! 

For endure great hardships in pioneer work
Raise the whip of the right hand
When is the partner's footsteps become so fast?
Sharp eyes
Lips closed without saying a word
The sound of condemning loud and heavy
Bigfoot
This growth arena couldn't bear it
Clatter! Clatter! Clatter! Clatter! Clatter! Clatter! Clatter!

The road ahead is so rampant
Watch out for every turn
The load on the chest will only be heavier and never be alleviated.
Firm my mind
Past memories like a burst of smoke
Can't change everything in the future will come true soon
Growing up
Real life in exchange for a dream
Yeah! Yeah! Yeah! Yeah! Yeah! Yeah! Yeah!
  1. Leading My Way

The colored pointed building looks down at the ferry port
Sadness be drifted 
By the curtain with hanging beads
Heartbroken rhymes
Let the horse run wild with it thousands of miles away

A banquet in the hall
Beauties move in high society
Slightly frowned eyebrows accompanied by piano sound
Colorful candle smog everywhere
Sipping a glass of wine
Waiting for that slight tipsy will come here
To poke fun at me

Colorful embroidery screen
A pair of Mandarin ducks snuggled each other
Spring fills the air with warmth
Surrounds the shadow of the cloister
The bells were sparse in the moonlight
In the midst of joy
How many fascinating sceneries
Leaving song on the pillow softly killing me

Letterhead that sealed the traces of tears
Huge palace boat
Carrying away from the sorrow of leaving hometown
With the afterglow of the setting sun
Far away and gradually disappear
Should I fold a branch of plum blossom?
Send it to the grass to lead the way
Where can I retrieve my lover?
  1. The Scenery Of A Small Town

The grass is warm in the spring sunshine
Spread on the surrounding hillside boundlessly
Until the front endlessly and incomparably
The wind not only shakes the leaves of the old tree
Also slowly moving the clouds
Inviting that white like birds' feathers
Dyeing the clear sky

Colored flowers scattered everywhere
Give a subtle smell
The birds’ quarrels are heard everywhere.
Like the sound of a bamboo flute resounding through the air
It’s all like telling
How beautiful is the scenery in this village?
Around the town
Birds' dance and floral fragrance
Wind unfolding hands
Trying to surround you in its embrace

Small temple at the end of the street
Unsealed fences and murals
Can't find any gemstones and brilliant bronze statues
And when you calm down
Sitting in front of the plate you can find
The sediment that belongs to your mind is actually mixed between the grass

The streetlight that just turned on is not so bright
The beggar sitting against it, all wrinkles on his face,
Arms that are obviously thin and dry
Try to support his determined eyes
Look at your heart every day at the corner of the street
  1. The Path Full Of Plum Blossoms


Travelers' steps are rushing as before.
That ruthless late autumn was still gone away in a hurry.
How could the autumn winds allow maple leaves residue?
When the reds were all faded.
The drunk guests in blue robes won't wait for the white fullness of the sky.
There are countless plum blossoms.
Little green fruits.
Hiding in the leaves.

Swallows flying,
Green water around the country houses quietly.
Calm was hard to be unruffled again.
Crowds flocked to come,
Blow up a mass of noises.
No way to distinguish between drunk and awake.
Except for the secret tears,
Poincettia could only be disguised as an expanse of white snow.

Under the high trees,
Beauties played on the swings.
White clothes, white clouds, and white snowflakes.
Laughter continually interrupted,
Didn't allow the spring not to back.
Unlimited reverie,
Always like to say there are other fish
In the sea.
  1. Incarnation Of The Rainbow

In the past
I curled body in the corner of the sky
Covered colorful colors and hide half of the body
Only revealed the most beautiful side to please you
Oh! My white cloud
When you looked up at me
How much praises in that exclamation
My heart danced for joy
Certified I will never be left out of your passion
Prayed silently that the sun light can be slightly weakened

Today
Looking at your figure gradually drifting away
With The rain’s melancholy and the wind’s ruthlessness
Feeling of helplessness like a dumb autumn cicada
Oh! My white cloud
How much I wanted to call you back at that time
Only begged the wind which wanted to take you away
Let me incarnate those colorful balloons
Let me follow you
Wherever and forever
  1. Snow Does Not Fall In My Hometown

When the moon stretched out its head in the gap between the clouds
The white light makes a silver world
The old hometown does not snow
Looking down the street from the second floor window
Street lights painted yellow on the brick surface
Street tree channeling high from the darkness
Leaves all fell due to the cold winter
Distorted branches towering into the sky
Songs of blessings come from far away
With the wings of imagination
simple-hearted leading the ride on the colored dragon
The wind whistled in the ears
The scaly claws of the dragon scratch the clenched hands
Candy hanging in the waist
By socks loopholes fall out
One second
Has been fleeing into the top of the cloud
Screaming over the head of Mom and Dad
Too late to lift their heads
Otherwise
They will be crazy shouting
Where to get the red boots
They must then pray
Dragon
Let our baby daughter slow down
  1. In My Dream, The Rainbow Never Sleep

Time passes
Try to maintain the same lengths of the grid
Such serenity does not contradict Einstein's cognition
A mountain edge touches the sunset
Cold in the red-hot
When the first light is covered
Driving the distant color clouds
Bringing down drizzle constantly 
The light that penetrates the top corner of the window
Stretching at different angles of refraction
Arch bridge-like a rainbow
Call the colored dragon to ring
My window that never closed

Sitting on the dragon's dorsal fin
Tight scales protect me from pain
That silhouette soars up into the sky just like lightning
Just all of a sudden comes on the top of the rainbow
Smoothly
Such as Newton’s ideal world can’t find the friction
Only that fine silk clothing
Which
Makes every effort to shout in the air
In an attempt to prevent the falling down of the figure
With equal acceleration
To reach the terminal speed detached from the surface

When I fall in at the bottom of the clouds
Pray that gravitation will not forsake me
The quality is a very customary joke
Perhaps
Only let myself return to the dream again
Can no longer hear
Galileo's boast
Break through Aristotle’s defense with wisdom
Where can I find?
The illusion of literature 
Where to find scientific endorsement
  1. THAT CLOUDS ON TOP OF THE VALLEYS

Out of the window
The white layer upon layer
Are that clouds or fogs?
Causing waves of debate
That cup of tea old friends handed up
The cup is boiling hot and small
A burst of light white smoke
Did not cause anybody's attention
We two can only occupy the corner to feel ourselves wronged, produce a forced smile

In this halfway up the mountain
Not high enough
Even the immortals are disdain to stay
That is the outside of the window
The wind rolled over and over again
Gone up
The people full of the house is only chasing out
All the cheers
Were kidnapped by the camera on the neck
In the panic, gradually away from
Gradually away from among the noisy

That corner
Even more lonely
We both look at each other to drink
Completely indifferent
That tea kettle
Has long been cooling
We found the answer in silence
Obviously
That the whole white vast out of the window
Are clouds but not
fogs

WHERE POETRY IS BORN

I see before me
Gardens suspended
Pendulous
between heaven and earth
Gardens floating
Filled with blooming unborn thoughts
Filled with blooming unborn words
Filled with blooming unborn colors
Slowly riping
Slowly materializing
Through different kinds of colors
Through diffefent kinds of feelings

Some of them will be beautiful and sensible
Some will touch your heart and your soul
Some will get sad and sorrowful
Because they haven't yet ripened
Some have frozen - in their own sorrows

Every thought hustles and bustles
Everyone wants to be there
But the poet decides
Which words and what thoughts
Should be chosen
To reflect the poem

If you want to be loved
And to feel real love
You have to sow
With small seeds
With the words of love
In the pendulous gardens
Between heaven and earth

But if you look back
And not look forward
Not even over the egde of what's real
Then the poem gets dark
The poem gets heavy
The poem gets sad

And it pulls you down
Instead of lifting you up
And then you can't see
The meaning of each life

So if anyone but me
Sees the pendulous gardens
Please - with the power of thoughts
And with encouraging words
Let the Pendulous gardens
Between heaven and earth
Be filled with unborn thoughts
Filled with unborn words
And filled with unborn poems
That slowly materializes
Through beautiful colors
And wonderful feelings!

المنتقى في المنازعات الشغلية على ضوء الفقه والعمل القضائي
                                       

الحمد لله الذي بنعمته تتم الصالحات، و الصلاة و السلام على أشرف المرسلين و على آله و صحبه أجمعين. و بعد:
 يسرني أن أقدم إلى القارئ الكريم مجموعة من المواضيع التي كانت أولى كتاباتي في قانون الشغل، حاولت من خلالها سبر أغوار مجموعة من الاشكاليات التي تهم المنازعات الشغلية، مستحضرة في ذلك النصوص التشريعية و اجتهاد القضاء و رأي الفقه سواء منها الوطنية أو المقارنة، و معززة بملحق يضم أحكام القضاء و بعض القوانين المستجدة في هذا الاطار.
 و لا يخفى علينا أن المقتضيات المتعلقة بقانون الشغل كانت متفرقة إلى أن شاءت إرادة المشرع ان يجمعها في إطار مدونة واحدة، حاول من خلالها ان يتطرق -ما أمكن- إلى مجموعة من القواعد التي تحكم علاقات الشغل الفردية و الجماعية.
 و لما كان تخصصي في الدراسات العليا هو قانون الشغل في إطار وحدة قانون الشغل و التحولات الاقتصادية و الاجتماعية فإني وجدت نفسي متشوقة للكتابة في هذا الفرع من فروع القانون. و هذه الكتابات هي محاولة يسيرة مني في قانون الشغل التي قلّت فيه الكتابات الفقهية رغم أنه يعتبر من أهم فروع القانون الخاص على الاطلاق، و الذي يتميز بحداثة قواعده إذ لم يستقل عن قواعد القانون المدني إلا في أوائل القرن التاسع عشر.
 و تظهر أهمية الكتابة في قانون الشغل انطلاقا من المجال الذي يؤثر فيه، و ما يترتب عنه في كثير من الأحيان من نزاعات تتطلب التوفيق بين طرفي العلاقة الشغلية، حفاظا على المقاولة و دعما للاقتصاد الوطني و تشجيعا للاستثمار الاجنبي.
 و قد خصصت هذه الدراسة لمناقشة عشرة مواضيع تتعلق ب:
  • مسطرة الصلح في المادة الشغلية
  • حدود سلطة قاضي الشغل في التفسير 
  •  حرية الاثبات في المادة الشغلية
  •  جزاء مخالفة النظام العام في قانون الشغل
  • تغيير المركز القانوني للمشغل و أثره على استقرار عقود الشغل
  •  حقوق الأجراء في نظام صعوبات المقاولة
  •  الأدوار الاجتماعية و الاقتصادية للسنديك في مسطرة معالجة صعوبات المقاولة 
  •  حقوق الأجراء القاصرين في مدونة الشغل
  •  رقابة تنفيذ المقتضيات المتعلقة بتشغيل الأجراء القاصرين
  •   "قراءة في القانون رقم 19.12 بتحديد شروط الشغل و التشغيل المتعلقة بالعاملات و العمال المنزليين"

 و في الختام أسال الله عز  جلاله أن يجعل هذه الدراسة خالصة لوجهه، إنه نعم المولى و نعم النصير، عليه توكلت و إليه أنيب، و على الله فليتوكل المتوكلون.

It seems to be a work of art carved from jade.
Mountains are now particularly beautiful against the backdrop of Osmanthus fragrans.

The moon shines like white hair.
White light and faith are warmer in autumn than in spring.

On Mid-Autumn Festival,
people hold up their wine glasses and face the beautiful night.
They look at the round moon and miss their distant relatives again.

If the moon rises to the top of the sky one day,
Then the whole world will be shrouded in silver light .
Although they don't know what's going to happen.

By a street of cobble stone in Helsingör
On a lovely Sunday morning
I met in a courtyard
A man I knew before

He reached out his hand
In which he held a notebook
-I have something for thou!
He smiled with his eyes half shut

-I just knew we would meet someday
I've chosen you for a journey over time
For a journey where time has no days

Therefor thou I visited in thyne dreams
And sometimes guided thou
For I saw thou had feeling
Thou could sense the balance
Between high and low
Between the beautiful and the sad
Where words are filled with emotions

Sometimes they are beautiful
Sometimes they are sad
Because time is unlimited
Using the power of words

-Here is my book!
He reached out his hand
-And what is your name?
I bashfully asked

-William, dear madame!
He replied with a bow
He lifted his hat
And then turned around

The Night

It turns into a dream like a long meteor,
Without a big smile.

There was a faint trembling of insects.
It's very quiet all around.
Everything is more relaxing in what a life.

If the water is telling quietly,
Is somebody in my dreams right now?
Maybe she is my favorite sunshine.

The stars are reflected in white.
A sea slowly enters the neon.
Tonight is a very good time.

Dear friends. The famous Moroccan poet Aziz Mountassir Aziz Mountassir recently translated my poem “God and I” from English to Arabic. Today I offer it to you. I take this opportunity to express my gratitude to the poet I respect from Casablanca, for a beautiful translation.

                                  

أنا والله

يقولون
الله هو رفيق الوحيدين
في شعبنا من زمن سحيق
 عشت حياتي وحدي
كل سنواتي
بطريقة الله معي
كان معي
 عندما لعنني الناس بلا قلب
 من أجل الحقيقة والصدق
وكبلوني  كالأخطبوط
 كان معي عند الدوس في الوحل
عندما شاهد الأقارب بكائي
 عندما عانيت من الألم
شاهدت  بصمت قريبة  الجلاد
 عندما  رفع عمي حجر ...
عندما حدد الجيران عيونهم
تمنوا الموت لي
لم يتركوا شيء
 سمحوا للكلاب تغضب مني
 أنقذني الله من أعدائي
له شكري
في وقتي الصعب
لم يغادرني
 دائما بقربي
لا حيلة لي هنا أبداً
الله لن يغادرني

God and I

"God is the companion of the lonely," they say
From time immemorial.
I lived a lonely life
But God has been with me all these years!

He was with me when my family
They filed an unclean trial against me.
When the people cursed heartlessly
For truth, honesty, capturing like an octopus.

He was with me when they trampled in the mud
When relatives watched my cry.
When I was in pain every time
Watched this my close, like an executioner.

When my aunt insulted
When uncle raised a stone at me ...
When the neighbors are looking contemptuously,
Wished me dead - He did not leave.

When a cousin let
His bastard dog on me.
Allah saved me from enemies
For which I thank his soul!

When it was hard for me in hard times
He did not leave - he was always there.
I think that God will not leave, -
Helpless me never!

Another dream,Ipainted in golden Rays
In your hand,i prayed,it could sustain
As you promised, to keep ,against unfair days..

Packed with love,I thought,and heavenly lights
Against seasons of life
And hoped it is safe
To lift my life,out of darkened nights
And fill my heart..until the coming grave...

But,grains of sand,run back to shore
Solely ,I returned,to my  drawn destiny
Who said dreams  reside in heart and core
And live long,as  a subtle  reality..

No matter,when a dream slips  of my life
Another castle will replace,with flying Hopes

ALL WILL BE WELL
Aabha rosy vatsa

                                    
 
 Of the four yugas in the world
I was born in Kaliyug, hands curled
Grew up in a revered home
Away from the city's dubious domes.
 
As I grew, I realized what a mess
Wrongdoings right and left I guess
Appalled at the lack of conscience
Pray, where has goodness gone, no sense.
 
Brother killing brother for money
Property, a bone of contention, O honey
Our conscience has frozen to sub zero
There is a mighty absence of real heroes.
 
Relationships are broken and mended daily
No more warmth of relations, hardly gaiety
Everyone is running a mad race
Hiding gory tales behind masked face.
 
But at last a joy reaches my ears
A multi-millionaire decides to donate an amount dear
An awesome way to celebrate his daughter's birthday
Making a cashless hospital, a magnanimity if I may say.
 
And the Sadhguru bemoans the fall of humanity
Shocked at the sale of children even before puberty
Pray what has humanity come to
He tries to raise a collective conscience too.
 
It is people like the millionaire and Sadhguru
Who reaffirm my faith in humanity anew
All will be well now I am sure
We just might save humanity by this cure.

شاهدتها في الحلم
أنها تنتظر قاربي
الذي حَلمَت به
وأيقَنَت بأنه حتماً
قادم مع التيار
وأدركت ما به ..
هو رسالتي الأخيرة
عند آخر لقاءاتي بها
ونسيَتها لحظة
نشوة قبلةٍ
طبعتها بكفها
كميثاق شرفٍ
ولحبنا برهان
وغادرتني مسرعةً

Blind and unseeing
Unseeing the good
In the one that had hurt me
So many times
Because of no reason
Just because - just because

I asked myself
So many times - so many times
Why?
Although I knew
I would never get no answer

But then you - came into my life
Like a burning torch
With warmth and love
And kind words of comfort

And I will never
Ever forget
When first I saw
The stars of hope
Light up
I saw them
In your eyes

Suddenly my road of life
Became lighter - brighter
Easier to bare
Suddenly I felt love
Love in full bloom
All around me
Everywhere

Your power of love
Your strength
Reflected in me
Comfort and security

And now I know
No matter how
The day our bodies
Tha day our souls
No longer dwell
Upon this earth

I will marry you
In all my future lives
For you have
For ever more
Lit the stars
For me!
